e\u011fitim kurumu m\u00fcd\u00fcr yard\u0131mc\u0131l\u0131\u011f\u0131na yap\u0131lacak atamalarda ise yaz\u0131l\u0131 s\u0131nav puan\u0131 ve Ek-1 Y\u00f6netici De\u011ferlendirme Formuna g\u00f6re yap\u0131lacak de\u011ferlendirme esas al\u0131narak hesaplanan puan\u0131,<\/p>\n<p>\u00e7) Bakanl\u0131k: Mill\u00ee E\u011fitim Bakanl\u0131\u011f\u0131n\u0131,<\/p>\n<p>d) E\u011fitim kurumu: Mill\u00ee E\u011fitim Bakanl\u0131\u011f\u0131na ba\u011fl\u0131 her derece ve t\u00fcrdeki okul ve kurumlar\u0131,<\/p>\n<p>e) Hizmet b\u00f6lgesi: \u0130llerde, Ek-2 Kurum Tipleri Tespit Formuna g\u00f6re tespit edilen A, B, C ve D e\u011fitim kurumu tiplerini,<\/p>\n<p>f) S\u0131nav Komisyonu: E\u011fitim kurumu m\u00fcd\u00fcr ve m\u00fcd\u00fcr yard\u0131mc\u0131l\u0131\u011f\u0131 i\u00e7in yap\u0131lacak yaz\u0131l\u0131 s\u0131navlara ili\u015fkin i\u015f ve i\u015flemleri y\u00fcr\u00fctmek \u00fczere Bakanl\u0131kta kurulan komisyonu,<\/p>\n<p>g) S\u00f6zl\u00fc S\u0131nav ve De\u011ferlendirme Komisyonu: E\u011fitim kurumu m\u00fcd\u00fcrl\u00fc\u011f\u00fcne atanacaklar\u0131n belirlenmesi amac\u0131yla illerde kurulan komisyonu,<\/p>\n<p>\u011f) Yer de\u011fi\u015ftirme: E\u011fitim kurumu m\u00fcd\u00fcr, m\u00fcd\u00fcr ba\u015fyard\u0131mc\u0131s\u0131 ve m\u00fcd\u00fcr yard\u0131mc\u0131lar\u0131n\u0131n, bu Y\u00f6netmelikle belirlenen usul ve esaslar \u00e7er\u00e7evesinde il i\u00e7erisinde g\u00f6rev yerlerini de\u011fi\u015ftirmelerini,<\/p>\n<p>h) Y\u0131l: G\u00f6reve ba\u015flama tarihine g\u00f6re ge\u00e7en on iki ayl\u0131k s\u00fcreyi,<\/p>\n<p>\u0131) Y\u00f6netici: Bakanl\u0131\u011fa ba\u011fl\u0131 e\u011fitim kurumlar\u0131nda m\u00fcd\u00fcr ve m\u00fcd\u00fcr yard\u0131mc\u0131s\u0131 g\u00f6revlerini y\u00fcr\u00fctenleri,<\/p>\n<p>ifade eder.<\/p>\n<p>\u0130K\u0130NC\u0130 B\u00d6L\u00dcM<\/p>\n<p>Ba\u015fvuru, Atama \u015eartlar\u0131 ve Komisyonlar<\/p>\n<p><b>S\u0131nava ba\u015fvuru ve atama \u015fartlar\u0131<\/b><\/p>\n<p><b>MADDE 5 \u2013<\/b> (1) Y\u00f6netici adaylar\u0131nda;<\/p>\n<p>a) Y\u00fcksek\u00f6\u011frenim mezunu \u00f6\u011fretmen olmak,<\/p>\n<p>b) Son ba\u015fvuru tarihi itibariyle Bakanl\u0131k kadrolar\u0131nda \u00f6\u011fretmen olarak g\u00f6rev yap\u0131yor olmak,<\/p>\n<p>c) Atanmak \u00fczere ba\u015fvurulacak e\u011fitim kurumuna alan\u0131 itibariyle \u00f6\u011fretmen olarak atanabilmek veya bu e\u011fitim kurumunda ayl\u0131k kar\u015f\u0131l\u0131\u011f\u0131 okutabilece\u011fi ders bulunmak; fen ve sosyal bilimler liseleri ile bilim ve sanat merkezleri y\u00f6neticili\u011fi i\u00e7in bu okullarda \u00f6\u011fretmenlik yapm\u0131\u015f veya yapmakta olmak,<\/p>\n<p>\u00e7) Bakanl\u0131k\u00e7a yap\u0131lan yaz\u0131l\u0131 s\u0131navda ba\u015far\u0131l\u0131 olmak,<\/p>\n<p>d) Yaz\u0131l\u0131 s\u0131nav\u0131n son ba\u015fvuru tarihi itibariyle m\u00fcd\u00fcrl\u00fck s\u0131nav\u0131 i\u00e7in bir y\u0131l m\u00fcd\u00fcr ba\u015fyard\u0131mc\u0131l\u0131\u011f\u0131 veya m\u00fcd\u00fcr yard\u0131mc\u0131l\u0131\u011f\u0131 veyahut m\u00fcd\u00fcr yetkili \u00f6\u011fretmenlik yapm\u0131\u015f olmak; m\u00fcd\u00fcr yard\u0131mc\u0131l\u0131\u011f\u0131 s\u0131nav\u0131 i\u00e7in de en az iki y\u0131l as\u0131l \u00f6\u011fretmenlik yapm\u0131\u015f olmak,<\/p>\n<p>e) Yaz\u0131l\u0131 s\u0131nav\u0131n son ba\u015fvuru tarihi itibariyle son d\u00f6rt y\u0131l i\u00e7inde adl\u00ee veya idar\u00ee soru\u015fturma sonucu y\u00f6neticilik g\u00f6revi \u00fczerinden al\u0131nmam\u0131\u015f olmak veya ayl\u0131ktan kesme veya daha a\u011f\u0131r bir disiplin cezas\u0131 almam\u0131\u015f olmak,<\/p>\n<p>\u015fartlar\u0131 aran\u0131r.<\/p>\n<p>(2) Y\u00f6neticilik s\u0131nav\u0131na ba\u015fvuru i\u00e7in birinci f\u0131kran\u0131n (d) bendinde belirtilen s\u00fcrelerin hesab\u0131nda, 657 say\u0131l\u0131 Devlet Memurlar\u0131 Kanununun 4\/B maddesi kapsam\u0131nda s\u00f6zle\u015fmeli \u00f6\u011fretmenlikte ge\u00e7en s\u00fcrelerin tamam\u0131 ile \u00f6zel okullarda \u00f6\u011fretmen veya y\u00f6netici olarak ge\u00e7en s\u00fcrelerin 2\/3\u2019\u00fc de\u011ferlendirilir.<\/p>\n<p><b>S\u0131nav duyurular\u0131 ve ba\u015fvuru<\/b><\/p>\n<p><b>MADDE 6 \u2013<\/b> (1) Y\u00f6neticilik yaz\u0131l\u0131 s\u0131nav\u0131, s\u0131nav tarihinden en az bir ay \u00f6nce Bakanl\u0131k\u00e7a, s\u00f6zl\u00fc s\u0131nav ise en az on g\u00fcn \u00f6nce ataman\u0131n yap\u0131laca\u011f\u0131 e\u011fitim kurumunun bulundu\u011fu il valili\u011fince duyurulur. Duyurularda s\u0131nav tarihi ve yerleri, ba\u015fvuru usul\u00fc ve s\u00fcresi ile di\u011fer hususlara yer verilir.<\/p>\n<p><b>Komisyonlar ve g\u00f6revleri<\/b><\/p>\n<p><b>MADDE 7 \u2013<\/b> (1) E\u011fitim kurumu y\u00f6neticili\u011fi s\u0131navlar\u0131n\u0131 y\u00fcr\u00fctmek \u00fczere Bakanl\u0131kta S\u0131nav Komisyonu, illerde S\u00f6zl\u00fc S\u0131nav ve De\u011ferlendirme Komisyonu olu\u015fturulur.<\/p>\n<p>(2) S\u0131nav Komisyonu; Bakanl\u0131kta, bir m\u00fcste\u015far yard\u0131mc\u0131s\u0131n\u0131n veya \u0130nsan Kaynaklar\u0131 Genel M\u00fcd\u00fcr\u00fcn\u00fcn veyahut g\u00f6revlendirilecek bir grup ba\u015fkan\u0131n\u0131n ba\u015fkanl\u0131\u011f\u0131nda, \u0130nsan Kaynaklar\u0131, Temel E\u011fitim, Orta\u00f6\u011fretim, Mesleki ve Teknik E\u011fitim, Din \u00d6\u011fretimi, \u00d6zel E\u011fitim ve Rehberlik Hizmetleri ile Yenilik ve E\u011fitim Teknolojileri Genel M\u00fcd\u00fcrl\u00fcklerinden birer grup ba\u015fkan\u0131 ile bir hukuk m\u00fc\u015favirinin kat\u0131l\u0131m\u0131yla dokuz as\u0131l \u00fcyeden olu\u015fturulur.<\/p>\n<p>(3) S\u0131nav Komisyonu, \u00fcye tamsay\u0131s\u0131yla toplan\u0131r ve oy \u00e7oklu\u011fuyla karar verir. S\u0131nav Komisyonunun sekretarya i\u015flemleri \u0130nsan Kaynaklar\u0131 Genel M\u00fcd\u00fcrl\u00fc\u011f\u00fcnce y\u00fcr\u00fct\u00fcl\u00fcr.<\/p>\n<p>(4) S\u0131nav Komisyonunun g\u00f6revleri \u015funlard\u0131r:<\/p>\n<p>a) Yenilik ve E\u011fitim Teknolojileri Genel M\u00fcd\u00fcrl\u00fc\u011f\u00fcnce yaz\u0131l\u0131 s\u0131nav sorular\u0131n\u0131n haz\u0131rlanmas\u0131 i\u00e7in 9 uncu maddenin birinci f\u0131kras\u0131n\u0131n (h) bendindeki mevzuat konular\u0131n\u0131 belirlemek,<\/p>\n<p>b) Yaz\u0131l\u0131 s\u0131nav\u0131n y\u00fcr\u00fct\u00fclmesine ili\u015fkin tedbirleri almak, genel g\u00f6zetim ve denetimi yapmak,<\/p>\n<p>c) Yaz\u0131l\u0131 s\u0131nav sonu\u00e7lar\u0131n\u0131n ilan\u0131n\u0131 sa\u011flamak.<\/p>\n<p>(5) S\u00f6zl\u00fc S\u0131nav ve De\u011ferlendirme Komisyonu; il mill\u00ee e\u011fitim m\u00fcd\u00fcr\u00fc veya g\u00f6revlendirece\u011fi bir mill\u00ee e\u011fitim m\u00fcd\u00fcr yard\u0131mc\u0131s\u0131 ba\u015fkanl\u0131\u011f\u0131nda, iki mill\u00ee e\u011fitim m\u00fcd\u00fcr yard\u0131mc\u0131s\u0131 veya \u015fube m\u00fcd\u00fcr\u00fc, bir il\u00e7e mill\u00ee e\u011fitim m\u00fcd\u00fcr\u00fc ile \u0130nsan Kaynaklar\u0131 Genel M\u00fcd\u00fcrl\u00fc\u011f\u00fc taraf\u0131ndan okul m\u00fcd\u00fcr\u00fc veya daha \u00fcst g\u00f6revlerde bulunan Bakanl\u0131k personeli veya \u00fcniversite \u00f6\u011fretim elemanlar\u0131 aras\u0131ndan g\u00f6revlendirilecek bir ki\u015finin kat\u0131l\u0131m\u0131yla be\u015f as\u0131l \u00fcyeden olu\u015fur. \u0130llerde gerekli durumlarda birden fazla komisyon kurulabilir.<\/p>\n<p>(6) S\u00f6zl\u00fc S\u0131nav ve De\u011ferlendirme Komisyonunun sekretarya i\u015flemleri insan kaynaklar\u0131 hizmetlerinden sorumlu \u015fube m\u00fcd\u00fcrl\u00fc\u011f\u00fcnce y\u00fcr\u00fct\u00fcl\u00fcr.<\/p>\n<p>(7) S\u00f6zl\u00fc S\u0131nav ve De\u011ferlendirme Komisyonunun g\u00f6revleri \u015funlard\u0131r:<\/p>\n<p>a) S\u00f6zl\u00fc s\u0131navlar\u0131 yapmak ve e\u011fitim kurumu y\u00f6neticili\u011fine atama puanlar\u0131n\u0131 belirlemek,<\/p>\n<p>b) S\u00f6zl\u00fc s\u0131navla ilgili itirazlar\u0131 de\u011ferlendirip oy \u00e7oklu\u011fuyla sonu\u00e7land\u0131rmak.<\/p>\n<p>(8) S\u0131nav Komisyonu ve S\u00f6zl\u00fc S\u0131nav ve De\u011ferlendirme Komisyonuna ikinci ve be\u015finci f\u0131kralarda belirtilen usullerle ayn\u0131 say\u0131da yedek \u00fcye belirlenebilir.<\/p>\n<p>(9) S\u0131nav Komisyonu ve S\u00f6zl\u00fc S\u0131nav ve De\u011ferlendirme Komisyonu ba\u015fkan ve \u00fcyeleri, kendilerinin veya bo\u015fanm\u0131\u015f olsalar dahi e\u015flerinin, ikinci dereceye kadar (bu derece d\u00e2hil) kan ve kay\u0131n h\u0131s\u0131mlar\u0131n\u0131n ve evlatl\u0131klar\u0131n\u0131n kat\u0131ld\u0131\u011f\u0131 s\u0131navlarda g\u00f6rev alamazlar.<\/p>\n<p>\u00dc\u00c7\u00dcNC\u00dc B\u00d6L\u00dcM<\/p>\n<p>S\u0131navlar ve De\u011ferlendirme<\/p>\n<p><b>Y\u00f6neticilik s\u0131navlar\u0131 ve de\u011ferlendirme<\/b><\/p>\n<p><b>MADDE 8 \u2013<\/b> (1) E\u011fitim kurumu y\u00f6neticili\u011fi s\u0131nav\u0131, e\u011fitim kurumu m\u00fcd\u00fcrl\u00fc\u011f\u00fc i\u00e7in yaz\u0131l\u0131 ve s\u00f6zl\u00fc s\u0131nav a\u015famalar\u0131ndan, m\u00fcd\u00fcr yard\u0131mc\u0131l\u0131\u011f\u0131 i\u00e7in ise yaz\u0131l\u0131 s\u0131navdan olu\u015fur.<\/p>\n<p>(2) Yaz\u0131l\u0131 s\u0131nav duyurusu \u0130nsan Kaynaklar\u0131 Genel M\u00fcd\u00fcrl\u00fc\u011f\u00fc taraf\u0131ndan yaz\u0131l\u0131 s\u0131nav tarihinden en az bir ay \u00f6nce Bakanl\u0131k internet sitesinden ilan edilir. Yaz\u0131l\u0131 s\u0131nav, Yenilik ve E\u011fitim Teknolojileri Genel M\u00fcd\u00fcrl\u00fc\u011f\u00fcnce kadro ihtiya\u00e7lar\u0131 dikkate al\u0131narak merkez\u00ee sistemle yap\u0131l\u0131r. Yaz\u0131l\u0131 s\u0131navda 100 tam puan \u00fczerinden 70 ve \u00fcst\u00fc puan alan adaylar ba\u015far\u0131l\u0131 say\u0131l\u0131r.<\/p>\n<p>(3) E\u011fitim kurumu m\u00fcd\u00fcrl\u00fc\u011f\u00fcne yap\u0131lacak atamalarda; t\u00fcr\u00fc itibar\u0131yla ayr\u0131 ayr\u0131 her ilde ilan edilen bo\u015f e\u011fitim kurumu y\u00f6neticili\u011fi say\u0131s\u0131n\u0131n \u00fc\u00e7 kat\u0131 kadar aday, yaz\u0131l\u0131 s\u0131navda ba\u015far\u0131l\u0131 olmak kayd\u0131yla puan \u00fcst\u00fcnl\u00fc\u011f\u00fcne g\u00f6re s\u00f6zl\u00fc s\u0131nava \u00e7a\u011fr\u0131l\u0131r. Adaylara, y\u00f6netici olarak atanmak istedikleri e\u011fitim kurumlar\u0131n\u0131 se\u00e7meleri i\u00e7in en fazla 20 tercih hakk\u0131 verilir. Adaylar tercihlerini elektronik ortamda, duyuru tarihinden itibaren 5 i\u015f g\u00fcn\u00fc i\u00e7erisinde ger\u00e7ekle\u015ftirirler.<\/p>\n<p>(2) S\u00f6zl\u00fc S\u0131nav ve De\u011ferlendirme Komisyonu taraf\u0131ndan adaylar\u0131n atanacaklar\u0131 e\u011fitim kurumlar\u0131; yapacaklar\u0131 tercihler ve atanma puan\u0131 \u00fcst\u00fcnl\u00fc\u011f\u00fcne g\u00f6re belirlenir. E\u011fitim kurumu y\u00f6neticileri, il mill\u00ee e\u011fitim m\u00fcd\u00fcr\u00fcn\u00fcn teklifi \u00fczerine vali taraf\u0131ndan atan\u0131r. Bu f\u0131kraya g\u00f6re yap\u0131lacak atamalar May\u0131s-Haziran aylar\u0131nda ilgili valiliklerce sonu\u00e7land\u0131r\u0131l\u0131r.<\/p>\n<p>(3) Adaylar, sadece kadrosunun bulundu\u011fu ildeki e\u011fitim kurumlar\u0131 y\u00f6neticiliklerine ba\u015fvurabilir.<\/p>\n<p>(4) Yat\u0131l\u0131 k\u0131z \u00f6\u011frencisi bulunan e\u011fitim kurumlar\u0131 ile \u00f6\u011frencilerinin tamam\u0131 k\u0131z olan e\u011fitim kurumlar\u0131n\u0131n m\u00fcd\u00fcr yard\u0131mc\u0131lar\u0131ndan en az biri \u00f6ncelikli olarak kad\u0131n adaylar aras\u0131ndan atan\u0131r.<\/p>\n<p>(5) \u0130mam hatip ortaokulu ve liseleri ile mesleki ve teknik e\u011fitim kurumlar\u0131n\u0131n m\u00fcd\u00fcr yard\u0131mc\u0131lar\u0131ndan en az biri \u00f6ncelikli olarak meslek dersi \u00f6\u011fretmeni adaylar aras\u0131ndan atan\u0131r.<\/p>\n<p>(6) M\u00fcd\u00fcr ba\u015fyard\u0131mc\u0131l\u0131\u011f\u0131na, kurumdaki m\u00fcd\u00fcr yard\u0131mc\u0131lar\u0131 aras\u0131ndan, kurum m\u00fcd\u00fcr\u00fcn\u00fcn inhas\u0131, il mill\u00ee e\u011fitim m\u00fcd\u00fcr\u00fcn\u00fcn teklifi ve valinin onay\u0131 ile e\u011fitim kurumu norm say\u0131s\u0131 kadar atama yap\u0131l\u0131r.<\/p>\n<p><b>Kurucu m\u00fcd\u00fcr<\/b><\/p>\n<p><b>MADDE 13 \u2013<\/b> (1) E\u011fitim ve \u00f6\u011fretime yeni a\u00e7\u0131lacak e\u011fitim kurumlar\u0131na; e\u011fitim kurumunu e\u011fitim ve \u00f6\u011fretime haz\u0131r hale getirmek, e\u011fitim ve \u00f6\u011fretime a\u00e7\u0131l\u0131ncaya ve norm kadroya ba\u011fl\u0131 atama yap\u0131l\u0131ncaya kadar ge\u00e7en s\u00fcre i\u00e7erisinde kurumun y\u00f6netim hizmetlerini y\u00fcr\u00fctmek \u00fczere, 5 inci maddeye g\u00f6re m\u00fcd\u00fcrl\u00fck s\u0131nav\u0131na girme \u015fart\u0131 ta\u015f\u0131yanlar aras\u0131ndan, valilikler taraf\u0131ndan kurucu m\u00fcd\u00fcr g\u00f6revlendirilebilir. Bu g\u00f6revde ge\u00e7en s\u00fcreler, bu Y\u00f6netmeli\u011fin uygulanmas\u0131nda e\u011fitim kurumu m\u00fcd\u00fcrl\u00fc\u011f\u00fcnde ge\u00e7en s\u00fcreler gibi de\u011ferlendirilir.<\/p>\n<p><b>M\u00fcd\u00fcr yetkili \u00f6\u011fretmenli\u011fe g\u00f6revlendirme<\/b><\/p>\n<p><b>MADDE 14 \u2013<\/b> (1) M\u00fcd\u00fcr normu bulunmayan e\u011fitim kurumlar\u0131nda fiilen g\u00f6revli \u00f6\u011fretmenler aras\u0131ndan, \u00f6\u011fretmenlik g\u00f6revi yan\u0131nda y\u00f6netim hizmetlerini de y\u00fcr\u00fctmek \u00fczere, il mill\u00ee e\u011fitim m\u00fcd\u00fcr\u00fcn\u00fcn teklifi ve valili\u011fin onay\u0131yla m\u00fcd\u00fcr yetkili \u00f6\u011fretmen g\u00f6revlendirilebilir. Bu g\u00f6revde ge\u00e7en s\u00fcreler, bu Y\u00f6netmeli\u011fin uygulanmas\u0131nda e\u011fitim kurumu m\u00fcd\u00fcr yard\u0131mc\u0131l\u0131\u011f\u0131nda ge\u00e7en s\u00fcreler gibi de\u011ferlendirilir.<\/p>\n<p><b>Merkez te\u015fkilata ba\u011fl\u0131 e\u011fitim kurumlar\u0131<\/b><\/p>\n<p><b>MADDE 15 \u2013<\/b> (1) Do\u011frudan Bakanl\u0131k merkez te\u015fkilat\u0131na ba\u011fl\u0131; hizmet i\u00e7i e\u011fitim enstit\u00fcleri, k\u0131z teknik olgunla\u015fma enstit\u00fcleri, ak\u015fam sanat okullar\u0131, \u00f6\u011fretmen evleri ile yayg\u0131n e\u011fitim kurumlar\u0131 ve di\u011fer kurumlar\u0131n y\u00f6neticiliklerine yap\u0131lacak atamalarda s\u00f6zl\u00fc s\u0131nav ve de\u011ferlendirme, e\u011fitim kurumunun bulundu\u011fu ilde kurulan S\u00f6zl\u00fc S\u0131nav ve De\u011ferlendirme Komisyonu taraf\u0131ndan yap\u0131l\u0131r. S\u00f6zl\u00fc S\u0131nav ve De\u011ferlendirme Komisyonu taraf\u0131ndan adaylar\u0131n atanacaklar\u0131 e\u011fitim kurumlar\u0131; yapacaklar\u0131 tercihler ve atanma puan\u0131 \u00fcst\u00fcnl\u00fc\u011f\u00fcne g\u00f6re belirlenir. E\u011fitim kurumu y\u00f6neticileri, il mill\u00ee e\u011fitim m\u00fcd\u00fcr\u00fcn\u00fcn teklifi \u00fczerine vali taraf\u0131ndan atan\u0131r.<\/p>\n<p>BE\u015e\u0130NC\u0130 B\u00d6L\u00dcM<\/p>\n<p>Hizmet B\u00f6lgeleri, Kurum Tiplerinin Tespiti ve Yer De\u011fi\u015ftirmeler<\/p>\n<p><b>Hizmet b\u00f6lgeleri ve kurum tipleri<\/b><\/p>\n<p><b>MADDE 16 \u2013<\/b> (1) Bu Y\u00f6netmeli\u011fin uygulanmas\u0131nda hizmet b\u00f6lgeleri her ilde\u00a0 Ek-2 Kurum Tipleri Tespit Formuna g\u00f6re tespit edilen e\u011fitim kurumu tiplerini ifade eder.<\/p>\n<p>(2) Her derece ve t\u00fcrdeki e\u011fitim kurumlar\u0131n\u0131n tipleri, Ek-2 \u00fczerinden yap\u0131lan de\u011ferlendirme sonucunda A, B, C ve D tipi olmak \u00fczere valiliklerce belirlenerek Bakanl\u0131\u011fa bildirilir.<\/p>\n<p><b>Hizmet s\u00fcresinin ba\u015flang\u0131c\u0131<\/b><\/p>\n<p><b>MADDE 17 \u2013<\/b> (1) D\u00f6n\u00fc\u015f\u00fcme, birle\u015fmeye, ad de\u011fi\u015fmesine, stat\u00fc de\u011fi\u015fikli\u011fine veya fiziki mekan de\u011fi\u015fikli\u011fine tabi tutulan e\u011fitim kurumlar\u0131 y\u00f6neticilerinin bulunduklar\u0131 kurumdaki hizmet s\u00fcresinin hesab\u0131nda bu y\u00f6neticilerin s\u00f6z konusu e\u011fitim kurumuna ilk atanma tarihi esas al\u0131n\u0131r.<\/p>\n<p>(2) \u0130ste\u011fe veya \u00e7al\u0131\u015fma s\u00fcresine ba\u011fl\u0131 olarak, kendi hizmet b\u00f6lgesine veya di\u011fer hizmet b\u00f6lgelerine yer de\u011fi\u015ftirme suretiyle atamas\u0131 yap\u0131lan y\u00f6neticilerin hizmet s\u00fcresi yeniden ba\u015flar.<\/p>\n<p><b>\u0130ste\u011fe ba\u011fl\u0131 yer de\u011fi\u015ftirmeler<\/b><\/p>\n<p><b>MADDE 18 \u2013<\/b> (1) G\u00f6revli olduklar\u0131 e\u011fitim kurumlar\u0131nda fiilen en az \u00fc\u00e7 y\u0131l g\u00f6rev yapan y\u00f6neticiler, il i\u00e7inde bo\u015f bulunan e\u011fitim kurumlar\u0131na, 5 inci maddenin birinci f\u0131kras\u0131n\u0131n (c) bendine uygun olmak kayd\u0131yla, kendi hizmet b\u00f6lgesindeki e\u011fitim kurumlar\u0131 i\u00e7in 10, bir alt veya bir \u00fcst hizmet b\u00f6lgesindeki e\u011fitim kurumlar\u0131ndan da 10 olmak \u00fczere en fazla 20 tercih yaparak yer de\u011fi\u015ftirme suretiyle atanma talebinde bulunabilir. Bu suretle yap\u0131lacak yer de\u011fi\u015ftirmeler; ba\u015fvuru tercihleri ve Ek-1 Y\u00f6netici De\u011ferlendirme Formu puan\u0131 \u00fcst\u00fcnl\u00fc\u011f\u00fcne g\u00f6re ilgili valiliklerce ger\u00e7ekle\u015ftirilir.<\/p>\n<p>(2) 12 nci maddenin alt\u0131nc\u0131 f\u0131kras\u0131na g\u00f6re atanan m\u00fcd\u00fcr ba\u015fyard\u0131mc\u0131lar\u0131, bo\u015f bulunan m\u00fcd\u00fcr yard\u0131mc\u0131l\u0131klar\u0131na bu madde kapsam\u0131nda yer de\u011fi\u015ftirme suretiyle atanma talebinde bulunabilirler.<\/p>\n<p>(3) Bu Y\u00f6netmeli\u011fin yay\u0131m\u0131 tarihinden \u00f6nce m\u00fcd\u00fcr ba\u015fyard\u0131mc\u0131s\u0131 olarak atananlar, tercihleri ve norm ihtiya\u00e7lar\u0131 dikkate al\u0131narak bu madde kapsam\u0131nda yer de\u011fi\u015ftirme suretiyle m\u00fcd\u00fcr ba\u015fyard\u0131mc\u0131s\u0131 olarak atanabilirler.<\/p>\n<p>(4) Bu maddeye g\u00f6re yer de\u011fi\u015ftirmelerde \u00e7al\u0131\u015fma s\u00fcresi 30 Haziran tarihi esas al\u0131narak belirlenir ve yer de\u011fi\u015ftirmeler her y\u0131l Temmuz-A\u011fustos aylar\u0131nda sonu\u00e7land\u0131r\u0131l\u0131r.<\/p>\n<p><b>\u00c7al\u0131\u015fma s\u00fcresine ba\u011fl\u0131 yer de\u011fi\u015ftirmeler<\/b><\/p>\n<p><b>MADDE 19 \u2013<\/b> (1) Bakanl\u0131\u011fa ba\u011fl\u0131 e\u011fitim kurumlar\u0131nda m\u00fcd\u00fcr, m\u00fcd\u00fcr ba\u015fyard\u0131mc\u0131s\u0131 ve m\u00fcd\u00fcr yard\u0131mc\u0131s\u0131 olarak g\u00f6rev yapanlar\u0131n yer de\u011fi\u015ftirmeleri, il i\u00e7inde b\u00f6lge hizmeti ve rotasyon esas\u0131na g\u00f6re yap\u0131l\u0131r.<\/p>\n<p>(2) M\u00fcd\u00fcr, m\u00fcd\u00fcr ba\u015fyard\u0131mc\u0131s\u0131 veya m\u00fcd\u00fcr yard\u0131mc\u0131s\u0131 olarak g\u00f6rev yapt\u0131klar\u0131 e\u011fitim kurumunda alt\u0131 y\u0131ll\u0131k \u00e7al\u0131\u015fma s\u00fcresini tamamlayan y\u00f6neticilerin g\u00f6rev yerleri; tercihleri ve Ek-1 Y\u00f6netici De\u011ferlendirme Formuna g\u00f6re hesaplanan puan \u00fcst\u00fcnl\u00fc\u011f\u00fcne g\u00f6re, 5 inci maddenin birinci f\u0131kras\u0131n\u0131n (c) bendine uygun olmak kayd\u0131yla de\u011fi\u015ftirilir.<\/p>\n<p>(3) Y\u00f6neticilerin her hizmet b\u00f6lgesi i\u00e7in belirlenen alt\u0131 y\u0131ll\u0131k hizmet s\u00fcrelerini ayn\u0131 e\u011fitim kurumunda tamamlamalar\u0131 esast\u0131r. Bulunduklar\u0131 hizmet b\u00f6lgesindeki hizmet s\u00fcresini tamamlayan y\u00f6neticiler, kendi hizmet b\u00f6lgesindeki e\u011fitim kurumlar\u0131 i\u00e7in 10, bir alt veya bir \u00fcst hizmet b\u00f6lgesindeki e\u011fitim kurumlar\u0131 i\u00e7in de 10 olmak \u00fczere en fazla 20 tercihte bulunurlar. Bu suretle yap\u0131lacak yer de\u011fi\u015ftirmeler; ba\u015fvuru tercihleri ve Ek-1 Y\u00f6netici De\u011ferlendirme Formu puan\u0131 \u00fcst\u00fcnl\u00fc\u011f\u00fcne g\u00f6re ilgili valiliklerce ger\u00e7ekle\u015ftirilir.<\/p>\n<p>(4) Tercihlerine g\u00f6re atamas\u0131 yap\u0131lamayan veya tercihte bulunmayanlar\u0131n atamalar\u0131 elektronik ortamda valiliklerce ger\u00e7ekle\u015ftirilecek kura sonucuna g\u00f6re hizmet b\u00f6lgelerinden birine re\u2019sen yap\u0131l\u0131r.<\/p>\n<p>(5) Bu maddeye g\u00f6re yer de\u011fi\u015ftirmelerde \u00e7al\u0131\u015fma s\u00fcresi 30 Haziran tarihi esas al\u0131narak belirlenir ve yer de\u011fi\u015ftirmeler her y\u0131l Temmuz-A\u011fustos aylar\u0131nda sonu\u00e7land\u0131r\u0131l\u0131r. Yer de\u011fi\u015ftirme i\u015flemlerinin takvimi ve ba\u015fvuruya ili\u015fkin hususlar valiliklerce duyurulur.<\/p>\n<p>(6) Bu madde kapsam\u0131nda yer de\u011fi\u015ftirmeye tabi e\u011fitim kurumu y\u00f6neticilerinden bo\u015f e\u011fitim kurumu bulunmamas\u0131 nedeniyle atamas\u0131 yap\u0131lamayanlar\u0131n yer de\u011fi\u015fiklikleri, bir sonraki \u00e7al\u0131\u015fma s\u00fcresine ba\u011fl\u0131 yer de\u011fi\u015ftirme d\u00f6neminde \u00f6ncelikli olarak ger\u00e7ekle\u015ftirilir.<\/p>\n<p>(7) 12 nci maddenin alt\u0131nc\u0131 f\u0131kras\u0131na g\u00f6re atanan m\u00fcd\u00fcr ba\u015fyard\u0131mc\u0131lar\u0131, bu madde kapsam\u0131nda m\u00fcd\u00fcr yard\u0131mc\u0131s\u0131 olarak yer de\u011fi\u015ftirirler. Ancak, bu Y\u00f6netmeli\u011fin yay\u0131m\u0131 tarihinden \u00f6nce m\u00fcd\u00fcr ba\u015fyard\u0131mc\u0131s\u0131 olarak atananlar, m\u00fcd\u00fcr ba\u015fyard\u0131mc\u0131s\u0131 olarak yer de\u011fi\u015ftirmeye tabi tutulur.<\/p>\n<p><b>Atama ve yer de\u011fi\u015ftirmelerde puan e\u015fitli\u011fi<\/b><\/p>\n<p><b>MADDE 20 \u2013<\/b> (1) Atamalarda ve yer de\u011fi\u015ftirmelerde puan e\u015fitli\u011fi halinde; s\u0131ras\u0131yla e\u011fitim d\u00fczeyi, \u00f6\u011fretmenlik kariyer basama\u011f\u0131 \u00fcst\u00fcnl\u00fc\u011f\u00fc, y\u00f6neticilikteki ve \u00f6\u011fretmenlikteki hizmet s\u00fcresi atamaya esas al\u0131n\u0131r.<\/p>\n<p><b>Soru\u015fturmaya ba\u011fl\u0131 yer de\u011fi\u015ftirmeler<\/b><\/p>\n<p><b>MADDE 21 \u2013<\/b> (1) Soru\u015fturma sonucu g\u00f6rev yerlerinin de\u011fi\u015ftirilmesi teklif edilen y\u00f6neticiler, \u00f6ncelikle alt hizmet b\u00f6lgelerinde bulunan e\u011fitim kurumlar\u0131na olmak kayd\u0131yla hizmet b\u00f6lgelerindeki ba\u015fka bir e\u011fitim kurumuna atan\u0131rlar.<\/p>\n<p>(2) Soru\u015fturma sonucu y\u00f6neticilik g\u00f6revinden al\u0131nmas\u0131 gerekenler ise ayn\u0131 veya ba\u015fka bir e\u011fitim kurumundaki durumuna uygun \u00f6\u011fretmen kadrosuna il i\u00e7inde veya iller aras\u0131nda atan\u0131r.<\/p>\n<p>(3) Bu madde kapsam\u0131nda yer de\u011fi\u015ftirme veya atamaya tabi tutulanlar, yeni g\u00f6revlerine ba\u015flad\u0131klar\u0131 tarihten itibaren d\u00f6rt y\u0131l s\u00fcreyle y\u00f6neticilik ba\u015fvurusunda bulunamaz, be\u015f y\u0131l ge\u00e7meden ayr\u0131ld\u0131klar\u0131 ile sekiz y\u0131l ge\u00e7meden ayn\u0131 e\u011fitim kurumuna hi\u00e7bir \u015fekilde y\u00f6netici olarak atanamazlar.<\/p>\n<p><b>Norm kadro fazlas\u0131 y\u00f6neticiler<\/b><\/p>\n<p><b>MADDE 22 \u2013<\/b> (1) Norm kadrosu kald\u0131r\u0131lan veya herhangi bir nedenle norm kadro fazlas\u0131 haline gelen y\u00f6neticiler, Ek-1 Y\u00f6netici De\u011ferlendirme Formuna g\u00f6re hesaplanan en d\u00fc\u015f\u00fck puandan ba\u015flanarak belirlenir. Bu y\u00f6neticiler, valiliklerce, talepleri ve hizmet gerekleri birlikte de\u011ferlendirilerek atanma \u015fartlar\u0131n\u0131 ta\u015f\u0131d\u0131klar\u0131 uygun g\u00f6r\u00fclecek e\u011fitim kurumu y\u00f6neticiliklerine \u00f6ncelikle atan\u0131rlar.<\/p>\n<p>(2) Birinci f\u0131kra kapsam\u0131ndakilerin y\u00f6neticilikleri, durumlar\u0131na uygun bo\u015f e\u011fitim kurumu bulunmamas\u0131 halinde, Bakanl\u0131\u011f\u0131n norm kadrolar\u0131n\u0131 onaylad\u0131\u011f\u0131 tarihten itibaren iki y\u0131l daha devam eder. Bu s\u00fcre i\u00e7erisinde bo\u015f e\u011fitim kurumu y\u00f6neticilikleri i\u00e7in yap\u0131lacak duyurulara ba\u015fvuruda bulunabilirler. Bu madde kapsam\u0131nda iki y\u0131ll\u0131k s\u00fcre i\u00e7erisinde ilgili mevzuat\u0131nda belirtilen y\u00f6neticilik normuna esas \u00f6l\u00e7\u00fctler \u00e7er\u00e7evesinde g\u00f6rev yapmakta oldu\u011fu e\u011fitim kurumunda durumuna uygun y\u00f6neticilik normunun artmas\u0131 ya da herhangi bir nedenle bo\u015f y\u00f6netici normu olu\u015fmas\u0131 halinde norm kadro fazlas\u0131 durumuna d\u00fc\u015fen y\u00f6netici bu kadroya atan\u0131r.<\/p>\n<p>(3) Bu madde kapsam\u0131nda iki y\u0131l i\u00e7erisinde y\u00f6netici olarak atamas\u0131 yap\u0131lamayan norm kadro fazlas\u0131 y\u00f6neticiler, istekleri de dikkate al\u0131narak kendi okullar\u0131na ya da ihtiya\u00e7 bulunan bir ba\u015fka e\u011fitim kurumuna \u00f6\u011fretmen olarak atan\u0131rlar.<\/p>\n<p>(4) Bu madde kapsam\u0131nda talepte bulunmayan y\u00f6neticilerin g\u00f6rev yerleri, Ek-1 Y\u00f6netici De\u011ferlendirme Formuna g\u00f6re hesaplanan en d\u00fc\u015f\u00fck puandan ba\u015flanarak re\u2019sen belirlenir.<\/p>\n<p><b>Y\u00f6neticilik g\u00f6revinin sona ermesi<\/b><\/p>\n<p><b>MADDE 23 \u2013<\/b> (1) E\u011fitim kurumu y\u00f6neticilerinden;<\/p>\n<p>a) Yurt d\u0131\u015f\u0131nda e\u011fitim m\u00fc\u015faviri, e\u011fitim ata\u015fesi, e\u011fitim ata\u015fe yard\u0131mc\u0131s\u0131 olarak atananlar, Bakanl\u0131klar aras\u0131 Ortak K\u00fclt\u00fcr Komisyonu karar\u0131yla g\u00f6revlendirilenler ile uluslararas\u0131 kurulu\u015flarda ya da yurt i\u00e7inde, Bakanl\u0131k ta\u015fra te\u015fkilat\u0131nda g\u00f6revlendirilenler hari\u00e7, bir y\u0131l ve daha fazla s\u00fcreyle ge\u00e7ici veya s\u00fcrekli olarak g\u00f6revlendirilenlerin y\u00f6neticilikleri,<\/p>\n<p>b) 657 say\u0131l\u0131 Devlet Memurlar\u0131 Kanununun 108 inci maddesinin (D) f\u0131kras\u0131 h\u00fck\u00fcmleri \u00e7er\u00e7evesinde bir y\u0131ldan daha fazla s\u00fcre ile ayl\u0131ks\u0131z izin alanlar\u0131n y\u00f6neticilikleri,<\/p>\n<p>c) 4688 say\u0131l\u0131 Kamu G\u00f6revlileri Sendikalar\u0131 ve Toplu S\u00f6zle\u015fme Kanununun 18 inci maddesi kapsam\u0131nda bir y\u0131ldan daha fazla s\u00fcre ile ayl\u0131ks\u0131z izin alanlar\u0131n y\u00f6neticilikleri,<\/p>\n<p>\u00e7) Norm kadro fazlas\u0131 durumuna gelen ve iki y\u0131l\u0131n sonunda durumlar\u0131na uygun e\u011fitim kurumu y\u00f6neticili\u011fine atanamayan y\u00f6neticilerin y\u00f6neticilikleri,<\/p>\n<p>d) Soru\u015fturma veya inceleme sonucu y\u00f6neticiliklerinin al\u0131nmas\u0131na karar verilenler ile 5 inci maddede \u00f6ng\u00f6r\u00fclen \u015fartlar\u0131 kaybedenlerin y\u00f6neticilikleri,<\/p>\n<p>sona erer.<\/p>\n<p>(2) Birinci f\u0131kran\u0131n (a), (b) ve (c) bentleri kapsam\u0131nda y\u00f6neticilikleri sona erenlerden bu durumlar\u0131 ortadan kalkanlar; daha \u00f6nce ayr\u0131ld\u0131klar\u0131 e\u011fitim kurumu y\u00f6neticili\u011finin bo\u015f olmas\u0131 durumunda \u00f6ncelikle bu e\u011fitim kurumlar\u0131na, bunun m\u00fcmk\u00fcn olmamas\u0131 ve talepleri halinde il mill\u00ee e\u011fitim m\u00fcd\u00fcrl\u00fcklerince \u00f6nerilecek durumlar\u0131na uygun bo\u015f bir e\u011fitim kurumu y\u00f6neticili\u011fine atan\u0131rlar. Bu \u015fekilde atanamayanlar, durumlar\u0131na uygun e\u011fitim kurumlar\u0131na \u00f6\u011fretmen olarak atan\u0131rlar.
