Geli\u015fen teknoloji sadece \u00e7evrenin kirlili\u011fi \u00fczerinde potansiyel bir tehlike de\u011fildir ayn\u0131 zamanda geli\u015fen teknoloji, \u00f6l\u00e7me sistemlerinin de daha hassasla\u015fmas\u0131n\u0131 ve etki-tesir aras\u0131ndaki ili\u015fkilerin detaylar\u0131 ile ayd\u0131nlat\u0131lmas\u0131na da yard\u0131mc\u0131 olmaktad\u0131r. <\/strong><\/span><\/div>\n<div style=\"text-align: left;\" align=\"center\">\n<span style=\"font-family: times new roman,times; font-size: small;\"><strong><\/strong><strong>Di\u011fer bir ifade ile ya\u015fad\u0131\u011f\u0131m\u0131z ortamda herhangi bir yabanc\u0131 maddenin var olup olmamas\u0131n\u0131n \u00f6l\u00e7\u00fclmesinden \u00f6te, \u00e7ok daha hassas \u00f6l\u00e7\u00fcmler gerektiren birim zamandaki de\u011fi\u015fim oranlar\u0131 da ancak geli\u015fen teknoloji sayesinde ger\u00e7ekle\u015ftirilebilmektedir.<\/strong><\/span><br \/>\n<span style=\"font-family: times new roman,times; font-size: small;\"><strong><\/strong><strong>Temel prensip olarak do\u011fada her aktivitenin \u00e7evreyi etkiledi\u011fi kabul edilmekle birlikte bu etkilenmenin <\/strong>zararlar\u0131 <strong>bak\u0131\u015f a\u00e7\u0131s\u0131na g\u00f6re de\u011fi\u015fmektedir. Do\u011fay\u0131 canl\u0131lar\u0131 ve ya\u015fam ko\u015fullar\u0131n\u0131 de\u011fi\u015ftirmeyen etkilerin en az\u0131ndan zarars\u0131z oldu\u011fu kabul edilmektedir. Dolay\u0131s\u0131yla tesis ile ilgili g\u00fcvenlik raporlar\u0131n\u0131n haz\u0131rlanmas\u0131nda belli bir hesaplama y\u00f6ntemi ve verileri mevcut olmal\u0131d\u0131r. Uluslararas\u0131 <\/strong>Atom Enerji<strong> Ajans\u0131 ve belli ba\u015fl\u0131 geli\u015fmi\u015f \u00fclkeler bu y\u00f6ntemleri haz\u0131rlam\u0131\u015flard\u0131r. \u00dclkemizde bu konu ile sorumlu olan kurulu\u015f ise T\u00fcrkiye Atom Enerjisi Kurumu ( TAEK) dir.<\/strong><\/span><\/p>\n<p>&nbsp;<br \/>\n<span style=\"font-family: times new roman,times; font-size: small;\"><strong><\/strong><strong>Burada d\u00fc\u015f\u00fcn\u00fclen \u00fc\u00e7l\u00fc karar y\u00f6ntemini k\u0131saca \u015f\u00f6yle a\u00e7\u0131klamak m\u00fcmk\u00fcnd\u00fcr; Tesisin yap\u0131m\u0131 i\u00e7in i\u015fletici dolay\u0131s\u0131yla yat\u0131r\u0131mc\u0131 kurulu\u015f haz\u0131rlad\u0131\u011f\u0131 raporla \u00f6nce in\u015faat, daha sonra i\u015fletme izni i\u00e7in gerekli resmi kurulu\u015flara ba\u015fvurur. Bu raporlar bilirki\u015filer taraf\u0131ndan incelenir ve bu sayede ba\u011f\u0131ms\u0131z kontrol mekanizmas\u0131 tesis edilmi\u015f olur. Bu arada tesisin yap\u0131m\u0131ndan etkilenecek olan ki\u015filerin tesisin yap\u0131m\u0131 ile itiraz hakk\u0131 bulunmaktad\u0131r. <\/strong><\/span><\/p>\n<p>&nbsp;<br \/>\n<span style=\"font-family: times new roman,times; font-size: small;\"><strong><\/strong><strong>Bu nedenle kimin hakl\u0131 kimin haks\u0131z oldu\u011funa karar verecek bir organa ihtiya\u00e7 duyuldu\u011fu ortaya \u00e7\u0131km\u0131\u015ft\u0131r. Bu organ \u00fclkelere g\u00f6re farkl\u0131l\u0131klar g\u00f6sterebilir. \u00d6rne\u011fin Almanya\u2019da bu organ mahkemelerdir. Bu mahkemelerde bilirki\u015filer, itiraz sahipleri ve proje sahipleri dinlenir. Hakim ge\u00e7erli olan kanun, y\u00f6netmenlik ve y\u00f6ntemlere uygun olarak karar verir. <\/strong><\/span><br \/>\n<span style=\"font-family: times new roman,times; font-size: small;\"><strong><\/strong><strong>Farkl\u0131 ki\u015filerin farkl\u0131 de\u011ferlendirmeleri olabilece\u011fi i\u00e7in karara bir \u00fcst mahkemede itiraz edilebilir. Sonu\u00e7ta halk-mahkeme-i\u015fletici \u00fc\u00e7l\u00fc karar mekanizmas\u0131 kurulmu\u015f olur. Yerel y\u00f6netimler al\u0131nan kararlar\u0131 uygulamakla y\u00fck\u00fcml\u00fcd\u00fcr.<\/strong><\/span><\/p>\n<p>&nbsp;<br \/>\n<span style=\"font-family: times new roman,times; font-size: small;\"><strong><\/strong><strong>Almanya&#8217;da M\u00fclheim-<\/strong>Kahrlich n\u00fckleer santral\u0131<strong> zemin problemlerinin ortaya \u00e7\u0131kmas\u0131 \u00fczerine so\u011futma kulesinin 20 metre kadar \u00f6telenmesi gerekmi\u015f ve in\u015faat ve yeni projeye g\u00f6re tamamlam\u0131\u015ft\u0131r. Ancak projenin de\u011fi\u015ftirildi\u011fi \u00f6ne s\u00fcr\u00fclerek mahkemeye yap\u0131lan itiraz ile santral\u0131n izni iptal edilmi\u015ftir. S\u00f6z konusu santral halen i\u015fletmeye ge\u00e7ememi\u015ftir. <\/strong><\/span><br \/>\n<span style=\"font-family: times new roman,times; font-size: small;\"><strong><\/strong><strong>G\u00f6r\u00fcld\u00fc\u011f\u00fc gibi hukuki konular \u00f6n plana ge\u00e7mekte ve karar s\u00fcreci y\u0131llarca uzayabilmektedir. Karars\u0131z ortamlar daima yat\u0131r\u0131m maliyetini ve riskleri artt\u0131r\u0131r.
